Pro-abortionists' Main Arguments

Understanding pro-abortionists' main positions may help you help legislators understand the weaknesses of those positions and the strength of your pro-life position. Some Sample Letters on Current Issues pages include pro-abortionists' positions on particular current issues; for example, regarding the "Freedom of Choice Act."

Pro-choice
http://en.wikipedia.org/wiki/Pro-choice
An overview of the "pro-choice" movement and position. "In its landmark 1973 case, Roe v. Wade where a woman challenged the Texas laws criminalizing abortion, the U.S. Supreme Court reached two important conclusions:

  • That abortion law was a federal constitutional law issue, not a state one, and was therefore subject to the Constitution of the United States and federal law;

  • That the procurement of an abortion was a constitutional right during the first and second trimesters of a pregnancy based on the constitutional right to privacy, but that the state's interest in protecting "potential life" prevailed in the third trimester unless the woman's health was at risk. In subsequent rulings, the Court rejected the trimester framework altogether in favor of a cutoff at the point of fetal viability (Cf. Planned Parenthood v. Casey)."

Supreme Court and Choice
http://www.pro-choicect.org/issues/supremecourt.shtml
Under "Cases that Shaped Choice," the history of the "right to privacy" as it relates to "reproductive rights" is briefly summarized -- from a 1965 decision involving marital privacy, to the extension of the "right to privacy" to include the right of unmarried people to obtain birth control, to the 1973 Roe v. Wade, which held that the "right to privacy" extends to a woman's decision whether or not to continue a pregnancy.

Why We're Pro-Choice
http://aclupa.blogspot.com/2007/01/why-were-pro-choice.html
"... The ACLU has recognized that the right to privacy, which encompasses the right to reproductive freedom, is among our most important constitutional liberties and has been a principle defender of abortion rights since 1973 when U.S. Supreme Court recognized the right to choose in Roe v. Wade. Reproductive freedom means the right to make informed decisions about whether and when to become a parent without government interference and to access a broad range of reproductive health care including contraceptives, prenatal care, treatment for sexually transmitted [disease], and abortion. While the ACLU identifies as pro-choice in constitutional terms, we realize that there are a number of other, sometimes much more personal, reasons why our staff, board members, volunteers, and members are pro-choice. Here are their reasons in their own words ..."

Abortion Issues
http://www.plannedparenthood.org/issues-action/abortion-issues-5946.htm
Planned Parenthood is committed to protecting and defending women's access to the full range of reproductive health care -- including access to abortion. Decisions about childbearing should be made by women, their families, and their doctors -- not by politicians. In order to make an informed decision, women need access to all reproductive health care options and should have the right to seek and obtain safe, legal abortion services without interference from the government. ... Freedom of choice is the cornerstone of reproductive rights. Planned Parenthood works in the states, at the federal level, and around the world to protect every woman's right to make her own decisions about childbearing. If politicians really want to reduce the number of abortions, they should adopt commonsense solutions, such as increased access to affordable contraception and comprehensive, medically accurate sex education.

"Reproductive justice ensures that women are healthy, both physically and emotionally; that they can make decisions about their bodies and sexuality free from government interference ... Congress is outlawing specific procedures and trying to grant rights to embryos and fetuses. ... The Hyde Amendment and state parental involvement laws have resulted in the deaths of women driven to back alley abortions. ... Opponents of abortion use clinic violence and harassment to prevent women from exercising their rights and drive away doctors and staff from providing services. ... So-called Crisis Pregnancy Centers use misinformation and intimidation to keep women from obtaining abortions. Often they are located right next to a [legitimate] women's clinic."

Designer Babies and the Pro-Choice Movement
http://www.dissentmagazine.org/article/?article=861
"... emphasizing the morality of abortion rights. Abortion should be legal because women should have the same rights as men to shape their lives; because sometimes bringing a child into the world is the wrong thing to do; because without legal abortion, women suffer and die. Abortion-rights advocates can frame abortion as a matter of social justice, not just of freedom from government interference. ..."
